ഓരോരോ യോഗങ്ങള്‍

യോഗ ചെയ്യുന്നതോ ചെയ്യാതിരിക്കുന്നതോ ഓരോരുത്തരുടെയും വ്യക്തിപരമായ പ്രശ്നമാണ്. ഐക്യരാഷ്ട്ര സഭ ഇതുപോലെ അനേകം പ്രഖ്യാപനങ്ങള്‍ നടത്താറും ലോകം മുഴുവന്‍ ആചരിക്കാറുമുണ്ട്. പക്ഷെ ഇന്നു വരെ ഒരു രാജ്യത്തെ ഭരണാധികാരിയും ഇതൊക്കെ ഇതുപോലെ ആഘോഷമാക്കി മാറ്റി മേനി നടിച്ച് കണ്ടിട്ടില്ല. അല്‍പ്പനര്‍ത്ഥം കിട്ടിയാല്‍ അര്‍ദ്ധ രാത്രിക്കും കുടപിടിക്കും എന്ന തരത്തിലാണ്, ഇന്‍ഡ്യന്‍ പ്രധാന മന്ത്രി നരേന്ദ്ര മോദിയുടെ അവസ്ഥ.
മോദി അധികാരമേറ്റിട്ട് ഒരു വര്‍ഷം കഴിഞ്ഞു. ഐക്യരാഷ്ട്ര സഭ ഇപ്പോള്‍ യോഗ ദിനമായി ആഘോഷിച്ച പോലെ അവരുടെ എല്ലാ ദിനങ്ങളും കഴിഞ്ഞ ഒരു വര്‍ഷം ആഘോഷിച്ചിട്ടുമുണ്ട്. പക്ഷെ മോദി അതൊന്നും അഘോഷിച്ചതായി കണ്ടില്ല. അപ്പോള്‍ ഈ യോഗ ആഘോഷത്തിനു പിന്നില്‍ വ്യക്തമായ അജണ്ടയുണ്ട്.
അനേകം പ്രശ്നങ്ങളില്‍ പെട്ടുഴലുന്ന ഒരു ദരിദ്ര രാജ്യമാണ്, ഇന്‍ഡ്യ. അധികാരത്തിലേറി ഒരു വര്‍ഷം കഴിഞ്ഞിട്ടും ഇന്‍ഡ്യയിലെ ഒരു പ്രശ്നമെങ്കിലും പരിഹരിക്കാനുള്ള രൂപ രേഖ തയ്യാറാക്കുകയോ ജനങ്ങളുടെ മുന്നില്‍ അവതരിപ്പിക്കുകയോ ചെയ്തിട്ടില്ല. തന്റെ പാര്‍ട്ടിക്ക് ഭൂരിപക്ഷമുള്ള പാര്‍ലമെന്റിനെ വരെ നോക്കുകുത്തിയാക്കി ഏകാധിപതിയേപ്പൊലെ തന്നിഷ്ടം നടപ്പിലാക്കുകയാണു മോദി ചെയ്തു കൊണ്ടിരിക്കുന്നത്. തീവ്ര ഹിന്ദുക്കളെ കയറൂരി വിടുകയും ചെയ്തിട്ടുണ്ട്. ഒരു വര്‍ഷം കൊണ്ട് 19 ലോക രാഷ്ട്രങ്ങള്‍ സന്ദര്‍ശിച്ചു കഴിഞ്ഞു. മംഗോളിയ പോലെ ഇന്‍ഡ്യയുമായി പ്രത്യേകിച്ച് ബന്ധമില്ലാത്ത രാജ്യങ്ങള്‍ക്ക് പണക്കിഴികളും നല്‍കി കഴിഞ്ഞു. ഇഷ്ട തോഴനായ അദാനിക്ക് ഓസ്ട്രേലിയയില്‍ ഖനി മേടിക്കാന്‍ ഇന്‍ഡ്യയിലെ നികുതി ദായകരുടെ പണം നല്‍കാനും തീരുമാനമായി. വിദേശത്തു പോകുമ്പോഴൊക്കെ കുത്തക മുതലാളിമാരെ മാത്രം കൂടെ കൊണ്ടു പോകുന്നു. അധികാരം മുഴുവന്‍ തന്നിലേക്ക് കേന്ദ്രീകരിക്കുന്നു. പണ്ട് ഇന്ദിര ഗാന്ധി ചെയ്തപോലെ എല്ലാം കൈപ്പിടിയില്‍ ഒതുക്കുന്നു. അദ്വാനി പറയുന്നതില്‍ കാര്യമുണ്ട്. മറ്റൊരു അടിയന്തരാവസ്ഥയിലേക്കാണോ ഇന്‍ഡ്യ പോകുന്നതെന്ന് ന്യായമായും സംശയിക്കേണ്ടി ഇരിക്കുന്നു. വിമര്‍ശിക്കുന്നവരുടെ വായടപ്പിക്കുന്നു. കേസെടുക്കുന്നു. കള്ളക്കേസുകളെടുക്കുന്നു. ഡെല്‍ഹിയിലെ തെരഞ്ഞെടുക്കപ്പെട്ട സര്‍ക്കാരിനെ പ്രവര്‍ത്തിക്കാന്‍ അനുവദിക്കുന്നില്ല.
മോദി വെറും വാഗ്ദാനങ്ങള്‍ മാത്രം നല്‍കുമ്പോള്‍ കെജ്‌രിവാള്‍ നല്‍കിയ വാഗ്ദാനങ്ങള്‍ നടപ്പിലാക്കി കൊണ്ടിരിക്കുന്നു. മോദിയുടെ കഴിവു കേട് മറ്റുള്ളവര്‍ തിരിച്ചറിയുന്നു എന്ന കുറ്റബോധം അദ്ദേഹത്തെ അലട്ടുന്നുണ്ട്. അതുകൊണ്ടാണ്, ഒരു ജനാധിപത്യ രാജ്യത്തിലെ ഭരണാധികാരി എങ്ങനെ ഭരിക്കണം എന്നു തെളിയിച്ചു കൊണ്ടിരിക്കുന്ന കെജ്‌രിവാളിനെ എല്ലാ തരത്തിലും ശ്വാസം മുട്ടിക്കാന്‍ മോദി ശ്രമിക്കുന്നതും.
മോദിയുടെ തെരഞ്ഞെടുപ്പു വാഗ്ദാനങ്ങളില്‍ വളരെ പ്രധാനപ്പെട്ട ഒന്നായിരുന്നു വിദേശത്തുള്ള കള്ളപ്പണം കൊണ്ടു വരും എന്നത്. അതിലേറെ പ്രസക്തം ഓരോ ഇന്‍ഡ്യക്കാരനും 15 ലക്ഷം രൂപ വച്ച് നല്‍കുമെന്നായിരുന്നു. കള്ളപ്പണമന്വേഷിച്ച് മോദി ഇപ്പോള്‍ 19 രാജ്യങ്ങളില്‍ അലഞ്ഞു കഴിഞ്ഞു. ഇന്‍ഡ്യയില്‍ കള്ളപ്പണം വെളുപ്പിക്കുന്ന ഏറ്റവും വലിയ പ്രസ്ഥാനം ഐ പി എല്‍ എന്ന കെട്ടു കാഴ്ച്ചയാണ്. അതിന്റെ ആദ്യ കാല സാരഥി ലളിത് മോദിയും നരേന്ദ്ര മോദിയുടെ പാര്‍ട്ടി നേതാക്കളും മന്ത്രിമാരും തമ്മിലുള്ള ഇടപാടുകളൊക്കെ ഇപ്പോള്‍ പരസ്യമായി കഴിഞ്ഞിരിക്കുന്നു.
അടിയന്തരാവസ്ഥയിലേക്ക് ഇനി അധിക ദൂരമൊന്നും ബാക്കിയില്ല. ഇന്ദിരാ ഗാന്ധി ജനാധിപത്യം അട്ടിമറിച്ചായിരുന്നു അടിയന്തരാവസ്ഥ പ്രഖ്യാപിച്ചത്. പക്ഷെ ഇപ്പോള്‍ ജനാധിപത്യം മാത്രമല്ല അട്ടിമറിക്കപ്പെടുന്നത്. ആയിരക്കണക്കിനു വര്‍ഷങ്ങളായി ഇന്‍ഡ്യ പിന്തുടരുന്ന മത സഹിഷ്ണുതയും കൂടി മോദി അട്ടിമറിക്കുകയാണ്.
ഓരോ ജനതക്കും അവര്‍ അര്‍ഹിക്കുന്ന ഭരണാധികാരിയെ ലഭിക്കുന്നു. ജനത മൂന്നാം കിട ആകുമ്പോള്‍ അവര്‍ക്ക് ഏഴാം കിട നേതാക്കളെയും ലഭിക്കും.

i agree that there is too much hype over the yoga thing......but then modi is not the first indian leader to organise mass yoga as a part of image building exercise.....that credit goes to nehru who organised it on a national level on his birthday.....modi went one step further and made it an international event

there are too many points of disagreements with the content.....so i would just skip commenting on those ......but i would like to point out one factual error.....the picture you showed as modi bowing before ms adani , actually shows a picture that appeared in kannada papers and it shows the mayor of tumkur Geetha Rudresh receiving modi for some function......the dirty tricks dept of AAP made it viral on social media as ms adani .....the truth was made public at that time itself but some people like you still seem to believe the lie.....just google "geetha rudresh" and check out

who is more intolerant of criticism.......kejriwal or modi......modi's critics like adwani are still in his party ......unlike kejriwals critics like yogendra yadav prashant bhushan etc who were thrown out of the party in the most unceremonious manner......

as for cases against critics, it was kejriwal whose govt filed defamation cases against media outlets that carried stories that brought out the fallacies of his party......on the one hand he impleaded himself in a suit filed by subramanian swamy asking court to do away with criminal defamation law and at the same time went on filing defamation charges against his critics.......as for cases against aap members , those are genuine legal actions against those who make fake degree certificates or indulge in domestic violence etc

at least a while back you used to hold prashant bhushan in high esteem on his legal acumen.......here is a quote from an interview by PB on the legal aspect behind the constitutional crisis brought about by the unprecedented confrontation with the governor by kejriwal.....

"AD: Where do you stand on the ongoing tussle between the chief minister and the lieutenant governor in Delhi?
PB: See, legally Delhi is still a union territory under the Constitution; a union territory that has been given an elected government which has some authority. The final authority, however, is still with the lieutenant governor and the union government. So therefore, Kejriwal and the AAP have been on the wrong side of the law in this fight.

It is true that the cause of giving full statehood to Delhi is an important issue that needs to be fought for, but the manner in which Kejriwal and his government has been fighting for it will only make the process more difficult and rigid in the future. They are setting a bad example.

The advice that I would give to him will be to come back to the founding principles of the party. I would urge him not to seek convenient legal advice. In this case with the LG, I believe he had gone to Mr [Fali Sam] Nariman who had given a contrary opinion, but that advice was suppressed. Then they went and asked for the advice of some people who don’t understand the Constitution—people who are being paid huge sums of money by the AAP—and they gave him the opinion he wished to hear. തീർത്തും സാങ്കേതികമായ കാരണങ്ങൾ പറഞ്ഞു ഒരു തിരെഞ്ഞെടുക്കപ്പെട്ട സർക്കാരിനു പ്രതിസന്ധിയുണ്ടാക്കുന്നതു ശരിയല്ല.

Legal experts are divided on whether LG has the powers to overrule the CM. But that's besides the point. What is the spirit of the constitution? The checks and balances in the constitution where LG can overrule the CM are meant for those situations where there is a direct conflict between the interests of center and state in Delhi. But BJP is misusing those technicalities to govern Delhi through the backdoor rather than respecting the people's mandate. That's unacceptable. BJP should accept their defeat with grace and let the democratically elected government function. Let the people judge AAP's rule during the next election.

നരേന്ദ്ര മോഡി തൊഴുന്ന സ്ത്രീ അദാനിയുടെ ഭാര്യ ഒന്നും അല്ല. അവർ തുംകൂർ മേയർ ഗീതാ രുദ്രേഷ് ആണ്. സംശയം ഉള്ളവർ 'Tumkur Mayor Geetha' എന്ന് വെറുതെ ഗൂഗിൾ ചെയ്താൽ മതി ഉത്തരം കിട്ടും. ഈ പോസ്റ്റിൽ എഴുതിയിരിക്കുന്ന അബദ്ധങ്ങൾ എല്ലാം ഇത്തരത്തിൽ തെറ്റിദ്ധരിക്കപ്പെട്ടു ഉണ്ടായതാണ്.

പാര്‍ലമെന്റിലെ ചവിട്ടു പടി ചുംബിച്ച് അവിടെ പ്രവേശിച്ച മോദി പാര്‍ലമെന്റിനെ നോക്കുകുത്തി ആക്കുന്നു. അദ്വാനിയെ നോക്കി കരഞ്ഞ മോദി പിറ്റേ ദിവസം അദ്ദേഹത്തിന്റെ ഓഫീസ് പൂട്ടി മുദ്രവയ്ക്കുന്നു. മോദി 12 വര്‍ഷം ഭരിച്ച് സ്വര്‍ഗ്ഗമാക്കി എന്ന് താങ്കളൊക്കെ അവകാശപ്പെടുന്ന ഗുജറാത്തില്‍ 67% ജനങ്ങള്‍ക്കും  മല വിസര്‍ജനത്തിനു പൊതു സ്ഥലങ്ങളെ അശ്രയിക്കേണ്ടി വരുന്നു. ഈ യാഥാര്‍ത്ഥ്യങ്ങളൊക്കെ ഉള്ളപ്പോഴും മംഗോളിയക്ക് പണം  വാരി കൊടുക്കുന്നു. അദാനിക്ക് ഓസ്ട്രേലിയയില്‍ ഖനി മേടിക്കാന്‍ പണം  കൊടുക്കുന്നു.

ഇന്‍ഡ്യയിലെ സാധാരണ ജനതയുടെ ബുദ്ധിമുട്ട് പരിഹരിക്കാന്‍ ഇത് വരെ മോദി എന്താണു ചെയ്തതെന്ന് താങ്കള്‍  വിശദീകരിക്കുക.

അദ്വാനി മോദിയെ വിമര്‍ശിച്ചതയി ഞാന്‍ കേട്ടില്ല. എന്തു വിമര്‍ശനമാണദ്ദേഹം നടത്തിയതെന്നു പറഞ്ഞാല്‍ നന്നായിരുന്നു.

യോഗേന്ദ്ര യാദവിനെയും പ്രശാന്ത് ഭൂഷനെയും പുറത്താക്കിയപോലെ അദ്വാനിയെ പുറത്താക്കിയാലും ഞാന്‍ അതിനെ സ്വാഗതം ചെയ്യും. പാര്‍ട്ടിക്കുള്ളില്‍ നിറുത്തി അവഹേളിക്കുന്നതിലും നല്ലത് പുറത്താക്കുകയാണ്.

പാര്‍ട്ടി അച്ചടക്കം ഓരോ പാര്‍ട്ടിയുടെയും അഭ്യന്തര പ്രശ്നമാണ്.

ഞാന്‍ പരാമര്‍ശിച്ചത് പാര്‍ട്ടിക്കുള്ളിലെ പ്രശ്നമല്ല. മാദ്ധ്യമങ്ങളിലൂടെ മോദിയെ വിമര്‍ശിക്കുന്നവര്‍ക്കെതിരെ കേസെടുക്കുന്ന വിഷയമാണ്. അത് മോദി ചെയ്തലും കെജ്‌രിവാല്‍ ചെയ്താലും ഞാന്‍ ഒരേ രീതിയിലേ കാണു.

ഇതിന്റെ നിയമ വശങ്ങളിലോ സാങ്കേതിക വശങ്ങളിലോ എനിക്ക് താല്‍പ്പര്യമില്ല. പ്രശാന്ത് ഭൂഷനെ ഞാന്‍ ഒപ്പോഴും ബഹുമാനിക്കുന്നു. പക്ഷെ ഇക്കാര്യത്തില്‍ അദ്ദേഹം പറയുന്ന നിയമവശം ഞാന്‍ അംഗീകരിക്കുന്നില്ല. ആ അഭിപ്രാഅയത്തോട് വിയോജിക്കുന്നു.

കെജ്‌രിവാളിന്റെ പാര്‍ട്ടി അടുത്ത തെരഞ്ഞെടുപ്പോടെ ഇല്ലാതാകും എന്ന് താങ്കള്‍  പല പ്രാവശ്യം പറഞ്ഞതോര്‍ക്കുന്നോണ്ടോ എന്തോ. അതെന്തെങ്കിലുമാകട്ടെ. മോദിയുടെ പാര്‍ട്ടിയെ നിര്‍ദ്ദയം തള്ളിക്കളഞ്ഞ് ഡെല്‍ഹിയിലെ ജനങ്ങള്‍ കെജ്‌രിവാളിന്റെ പാര്‍ട്ടിയെ തെരഞ്ഞെടുത്തു. അതും ഇന്‍ഡ്യയുടെ ചരിത്രത്തില്‍ ആദ്യമായി 50% വോട്ടിനു മുകളില്‍ നല്‍കി. ആ ജനാധിപത്യത്തെ ബഹുമാനിക്കാന്‍ മോദിക്കാകുന്നില്ല.

ജനാധിപത്യത്തിലെ ഭരണം എന്നു പറയുന്നത് മോദി കരുതുമ്പോലെ ഏകാധിപത്യമല്ല. കൂട്ടായ പ്രവര്‍ത്തനമാണ്. ഒരു മുഖ്യമന്ത്രിക്ക് അദ്ദേഹത്തിന്റെ നിലപാടുകളോട് യോജിപ്പുള്ള ഉദ്യോഗസ്ഥരെ ആണവശ്യം. മോദി പ്രധാനമന്ത്രി ആയപ്പോള്‍  അദ്ദേഹം തെരഞ്ഞെടുത്ത ഉദ്യോഗസ്ഥരും ഇതുപോലെ ആയിരുന്നു. അത് കെജ്‌രിവാളിനനുവദിക്കാന്‍ എന്തുകൊണ്ട് മോദി സമ്മതിക്കുന്നില്ല? വളരെ മോശമായ നിലപാടല്ലെ ഇത്. ലെഫ്റ്റനന്റ് ഗവര്‍ണ്ണര്‍ക്ക് ഭരണ ഘടന നല്‍കുന്ന ചില അധികാരങ്ങളുടെ മറ പിടിച്ച് ഇപ്പോള്‍ മോദി കളിക്കുന്ന മൂന്നാം കിട കളി താങ്കള്‍ക്ക് മനസിലകാഞ്ഞിട്ടല്ല. വെറുതെ തര്‍ക്കത്തിനു വേണ്ടി വാദിക്കുന്നു.

ജനാധിപത്യത്തോട് തരിമ്പെങ്കിലും ബഹുമാനമുണ്ടെങ്കില്‍ മോദി ചെയ്യേണ്ടത് കെജ്‌രിവാളിനെ ഭരിക്കാന്‍ അനുവദിക്കയാണ്. മോദിയില്‍ നിന്നും ഞാന്‍ അത് പ്രതീക്ഷിക്കുന്നില്ല. മോദിക്ക് മോദി ആകാനേ പറ്റൂ.

Kejriwal's proposal was not to file case against critics, rather it was to file defamation cases against the media outlets that publish utter lies to defame AAP. AAP has pointed out several instances of such lies published by the media (fondly called by BJP as Presstitutes). One example being the fictitious fight between NTPC and Delhi govt due to which Delhi was supposed to be denied electricity. If one cannot file defamation suit against defamatory news, then what is the law meant for?

Curiously, NDTV's ad itself says "The biggest danger to Indian Television is, Hysteria, Wild Accusations, Polarization, Tabloid News." AAP agrees with this completely and want some action against those who publish such wild accusations. Is that wrong? Gadkari can file defamation suit against Kejriwal. But Kejriwal can't do that, is that fair?

മുഖ്യമന്ത്രിക്കും മന്ത്രിമാര്‍ക്കുമെതിരെ ആരോപണമുണ്ടായാല്‍ അത് എങ്ങനെ കൈ കാര്യം ചെയണമെന്നതിനു രൂപ രേഖ ഉണ്ടാക്കുകയാണവിടെ ചെയ്തത്. സര്‍ക്കാരിനെതിരെ ആരോപണമുണ്ടായാല്‍  സര്‍ക്കാര്‍ ഉദ്യോഗസ്ഥര്‍ അത് പ്രിന്‍സിപ്പല്‍ സെക്രട്ടറിക്ക് റിപ്പോര്‍ട്ട് ചെയ്യണം. അദ്ദേഹമ ത് പരിശോധിച്ച് അടിസ്ഥാനരഹിതമാണോ എന്ന് തീരുമാനിക്കാന്‍ പ്രൊസെക്യൂഷന്‍  വകുപ്പിനു റഫര്‍ ചെയ്യും. പിന്നീടത് നിയമവകുപ്പിന്റെയും ആഭ്യന്തര വകുപ്പിന്റെയും പരിഗണക്കു വിടും. ഈ പരിശോധനകളൊക്കെ കഴിഞ്ഞ് ആരോപണം  അടിസ്ഥാന രഹിതമാണെങ്കില്‍ അതില്‍ നിയമ നടപടിക്ക് ശുപാര്‍ശ ചെയ്യും എന്നാണാ സര്‍ക്കുല എന്നേ ഞാന്‍ മനസിലാക്കിയിട്ടുള്ളു.

മാദ്ധ്യമങ്ങളില്‍ ഒരു വാര്‍ത്ത വരുമ്പോഴേക്കും ഉടനെ കേസെടുക്കാനൊന്നും ആ സര്‍ക്കുലറില്‍ നിര്‍ദ്ദേശിക്കുന്നില്ല.

just because a govt has been elected by a vast majority , it does not mean that they can attempt to exercise powers beyond what has been granted to them under the constitutional scheme.......for example , suppose one party wins all the seats in Trivandrum corporation election and if the mayor adopts a confrontationist attitude with the state govt ruled by another party, there is no point in saying that it is just a legal technicality that the state govt has powers exceeding those of the local body ,what is important is the will of the people etc....they are not going to gain anything by that except bring misery on the people who elected them......in this case the most relevant thing is that in view of the fact that delhi is the capital of the union of india and also the seat of the central govt, it is a union territory and the elected govt has been granted limited powers under the constitution ....this state of affairs is not something that has been put in place after aap govt came to power ....earlier many parties formed govt there and ruled without any constitutional crisis even while a different party ruled at the centre......it is not that aap or kejriwal does not know all this....but he is interested in creating dramas than settle down to rule in a responsible fashion......the present crisis was deliberately created by kejriwal over a non-issue over appointment of a temporary chief secretary......in any case publicly disgracing senior functionaries of own goverment , locking them out of office etc are not the way to change the present law......it requires a constitutional amendment to make delhi a full-fledged state, which is unlikely to happen anytime soon..........therefore they are tring to achieve that through litigation and court verdicts........last time he resigned in 49 days purpotedly because lokpal bill was not allowed to be tabled.....this time even with brute majority there is no talk of any lokpal bill even after so many months in power.....well people already know his approach towards lokpal from the way party's internal lokpal adm ramdoss was shown the door when he pointed out some wrong doing by the leadership and then replaced by some compliant hands.....

that is true for all full-fledged states......but delhi is not yet a full-fledged state, but a union territory with an elected assembly and govt that has been granted limited powers.....for example the state govt does not have any authority over the police department as it comes under the home ministry of the central govt......even when kejriwal approached court on the appointments issue what the court asked for was the procedure that is in place in other union territories for similar appointments....... it needs a constitutional amendment to make delhi a full-fledged state ......till the time such an amendment comes to pass, any govt in delhi will have to comply with the law as it exists now, which gives overreaching powers to the LG and the central govt......that being the ground reality, all key appointments will have to be made on a consensual manner and the chief minister cannot have his way like it happens in full fledged states like kerala or any other......but instead of the consensual path followed by all previous chief ministers kejriwal is choosing the path of confrontation for his own reasons

In your example, the mayor should be allowed to choose his staff. Similarly, Delhi CM should be allowed to choose his staff. It is the LG who adopted a confrontationist attitude, not Kejriwal. Normally, the LG is supposed to respect the wishes of the CM, unless there is a serious conflict of interest with the center. Instead, LG is hell bent on creating roadblocks for the CM in each and every step.

Delhi is not a union territory like Chandigarh or Andaman. Unlike other UTs, Delhi has an elected govt and chief minister. Unlike other UTs, Delhi is not directly governed by the center but by the elected govt. Yes, technically Delhi is a UT and center has some powers in Delhi. But those powers of the center are supposed to be exercised only during a crisis, that too with extreme caution. I haven't heard a situation in Delhi where the LG disregards the wishes of the CM and makes his own appointments. Here we have a situation where LG makes direct appointments without even consulting the CM and BJP claims that Delhi CM is nothing more than a glorified municipal commisioner.

What is duplicious about his stand? The law should be same for Kejriwal and media. If defamation is criminal for Kejriwal, it should be the same for media too. What's good for the goose is good for the gander. Kejriwal believes that the criminal provisions associated with defamation are too harsh and arbitrary and should be changed. He never said that the law against defamation should be removed. If someone believes that death penalty for murder is too harsh, then would it be duplicious if he files a murder case against a murderer?

that situation was created by kejriwal by his refusal to finalise on a consensus candidate and his insistance on having his own choice approved by LG.....as mentioned in my earlier posts the constitutional scheme of things in delhi are radically different from full-fledged states where the role of the governor is largely ceremonial.....LG has the power to appoint a suitable person as it was his constitutional duty to see that a key position like chief secretary was not left void

According to BJP govt's circular, Delhi govt does not have the power punish even a constable who's caught red handed. Then what lokpal are we talking about? Delhi govt has moved to court against the stand of the center. The situation has to be clarified by the court before Jan Lokpal can be passed.

perhaps you are not aware of the facts about the suit filed by subramanian swamy, which seeks to set aside the defamation law, on the ground that the IPC provisions put unreasonable restrictions on people's right to free speech and expression guaranteed under Article 19 (1) (a) of the Constitution. Arvind Kejriwal and later Rahul Gandhi too joined as supporting parties to it.......now on the one hand arguing that a particular law is to be set aside in one court and at the same time invoking the same law in another court , is a duplicitous stand, is what i said

Of course, every CM needs candidates of his/her choice to govern effectively. It is the LG, who created the confrontation by disregarding the decision of the elected goverment. Was this a crisis situation for the LG to overrule the CM?

Again, as I said, that's mere technicality. Constitutional experts are divided even on that technicality. But the spirit of the constitution is to respect the democratically elected govt and exercise those powers of the LG only during major conficts between the center and the state. It is an elected govt that has promises to fulfill, not the LG. If things are not going smoothly, then people will ask the elected govt, not the LG. If people are not happy with the governance, then people and only outst the govt, not LG. It is only logical that one cannot have great powers without great responsibilities.

I'm talking about Kejriwal's plea here. His plea was only to remove a certain provision that imposes arbitrary punishment for defamation, not to remove the defamation law. The court has tagged pleas around defamation law together, that's all.

Whether police is under home ministry or not is not the question. The question is whether Delhi govt can arrest the corrupt officials. First BJP govt said that ACB cannot arrest corrupt police officers. AAP went to court and the high court ruled that ACB can arrest Delhi police. Now BJP has issued a new circular saying that Delhi govt cannot arrest corrupt central govt officers. Let the court decide and the Jan Lokpal bill will be passed based on that.

there has been no change in the constitutional provisions since the union territories act of 1963 and further the Constitution (Sixty ninth Amendment ) Act 1991 that provided for elected assembly......the powers of the elected govt has been restricted largely to "municipal functions" all through and it has nothing to do with aap winning the last election or bjp losing etc........if somebody wants to change the scheme of things that exist now,the only way to achieve that is to get an amendment passed in the parliament with two thirds majority........kejriwal knows this all too well , but creates confrontation and drama as it keeps him in media limelight and perhaps he hopes to build the image of someone taking on the centre out to suppress the small state etc through these shenanigans

I'm talking about the interpretation of those provisions. The understanding till BJP came to power was that Delhi govt can arrest corrupt officials. BJP claimed that Delhi govt cannot arrest the corrupt police officers. Delhi High Court ruled that Delhi govt CAN arrest corrupt police officers.

Delhi govt has full power just like any other state except in areas of Police, Land and public order. Since BJP was kicked out mercilessly by the Delhi electorate, they want to restrict the elected govt to "municipal functions". For that they're creating daily confrontations using the LG.

pronouncements by single judges on this issue are not conclusive proof.....such litigation is part of dilatory tactics.....what i hope is that the matter would be decided by a constitution bench of the supreme court on a presidential reference...like i said before even a corporation mayor is elected by people....but that does not bestow him the power to appoint or transfer his staff , which rests with the state govt......however much his majority , the mayor is expected to work in a consensus mode with the state ministry ......the ground reality that inspite of having elected assembly and govt , delhi and pondichery continue to be union territories for all practical purposes, till a constitutional amendment makes them full-fledged states.....that fact is not something that the present bjp govt created but already existed......the present delhi govt attempted to exercise powers beyond what earlier govts in delhi had done and that precipitated the crisis....just because the assembly and the state ministries are located within his jurisdiction , the mayor cannot attempt to exercise his authority over it or the state govt or their employees, whatever majority he may have in the corporation......afterall even if one looks at peoples mandate, delhi govt represents just 1.5 crores while the central govt has a mandate of the 90 crores electorate

in the anil sibal case kejriwal questioned the constitutional validity of the defamation law.......however much you try to give a positive spin on this issue there is no escaping from the fact that a bench of the supreme court made observations on his hydra-headed stand ......check THIS out

"A bench headed by justice Dipak Misra asked Kejriwal how he could issue such a diktat, when he recently argued in favour of freedom of speech in the Supreme Court after a couple of defamation cases were filed against him.

first of all you reproduce a photoshopped picture with imprinted text indicating it to be ms.adani.........if indeed it were ms.adani, anybody would find the show of such humility somewhat out of place from the prime minister of the country ,as the photoshopped picture was created to show modi in a bad light as being servile before madam adani.........however once it is pointed out that in truth it shows the mayor of a town receiving the pm who arrived for some function, it would be obvious to anyone that the pm is being graceful in showing such humility to the host who ranks far lower in the protocol position.......because of your blind hatred for modi , you find even such graceful behaviour as reprehensible acting........i wonder how you perceive the act of kissing the ground by pope on arrival in a country......or how healthy is the habit of pope or other worthies in kissing the feet of the poor etc......acts of humility or play acting?

സിംഗിള്‍ ജഡ്ജിയുടെ വിധി അവസാന വാക്കല്ല. പക്ഷെ അതു സ്റ്റേ ചെയ്യാത്തിടത്തോളം അതിനു പ്രാബല്യമുണ്ട്. അതനുസരിച്ച് അഴിമതിക്കാരായ പല പോലീസുകാരെയും അറസ്റ്റ് ചെയ്തിട്ടുമുണ്ട്. പരമോന്നത നീതി പീഠം തീരുമാനിക്കുന്നതു വരെ ഈ വിധി നിലനില്‍ക്കുകയും ചെയ്യും.

എന്തുകൊണ്ട് ഭൂരിപക്ഷമുണ്ടായിട്ടും ലോക് പാല്‍ ബില്ല്, അവതരിപ്പിച്ചില്ല എന്ന താങ്കളുടെ ചോദ്യത്തിനു കൂടെ ഇതില്‍ ഉത്തരമുണ്ട്. നീതിപീഠത്തിന്റെ അവസാന വിധി വരുമ്പോള്‍  ഈ നിയമം കെജ്‌രിവാള്‍ അവതരിപ്പിക്കും. അഴിമതിക്കാരായ സര്‍ക്കാര്‍ ഉദ്യോഗസ്ഥര്‍ക്കെതിരെ നടപടി എടുക്കാന്‍ അധികാരമില്ലാത്ത ഒരു ലോക് പാല്‍ കൊണ്ട് പ്രത്യേക ഗുണമൊന്നുമില്ല. ഇതു വഴി ഏതായാലും മോദിയുടെ അഴിമതി വിരുദ്ധ മുഖം മൂടി അഴിഞ്ഞ് വീണിട്ടുണ്ട്. കൂടെ സുഷമ വസുന്ധര ലളിത് മോദി ബന്ധങ്ങളും സാക്ഷി.

ആദ്യം ലോക് പാല്‍  ബില്ല്, അവതരിപ്പിച്ചത് കോണ്‍ഗ്രസിന്റെയും  ബി ജെപിയുടെയും നിലപാട് അനാവരണം  ചെയ്യാന്‍ വേണ്ടി തന്നെ ആയിരുന്നു. കൊണ്‍ഗ്രസിന്റെ പ്ന്തുണയോടെ അഞ്ച് വര്‍ഷം ഭരിക്കാനൊന്നും കെജ്‌രിവാള്‍ ഉദ്ദേശിച്ചിരുന്നില്ല. അത് തുടരുമായിരുന്നു എന്നും  സുബോധമുള്ള ആരും കരുതുകയും ഇല്ല. അദ്ദേഹം ഒളിച്ചോടുന്നു എന്ന് ആവര്‍ത്തിച്ച് രണ്ടു പാര്‍ട്ടികളും ആരോപിച്ചപ്പോള്‍ ഒളിച്ചോടുന്നില്ല എന്നു തെളിയിക്കാന്‍ അദ്ദേഹം ഭരണം ഏറ്റെടുത്തു. 49 ദിവസമേ ഭരിച്ചുള്ളൂ എങ്കിലും  സാധാരണ ജനങ്ങള്‍ക്ക് വേണ്ടി ഭരിക്കും എന്നദ്ദേഹം തെളിയിച്ചു. അതു മാത്രമേ അദ്ദേഹം ഉദ്ദേശിച്ചിരുന്നുമുള്ളു. സി പി എം പണ്ട് ചെയ്ത ചരിത്രപരമായ മണ്ടത്തരം  ആവര്‍ത്തിക്കാന്‍ അദ്ദേഹം തുനിഞ്ഞില്ല, അതുകൊണ്ട് മികച്ച നേട്ടമുണ്ടാക്കാനും സാധിച്ചു. അത് മികച്ച ഫലവും നല്‍കി. ഏതളവു കോലുവച്ചളന്നാലും ഇപ്പോള്‍ അദ്ദേഹം ഭരിക്കുന്ന രീതി മോദിയുടെ ഭരണത്തേക്കാള്‍ ഏറെ മുന്നിലാണ്. അതിന്റെ പ്രത്യക്ഷ തെളിവാണ്, ഇപ്പോള്‍ അവതരിപ്പിച്ചിട്ടുള്ള ബജറ്റും.

അത് കെജ്‌രിവാളിനു പറ്റിയ തെറ്റു തന്നെയാണ്. അതിനു പ്രായശ്ചിത്തം ​ചെയ്തു. ആ മന്ത്രിയെ അദ്ദേഹം പുറത്താക്കി. പാര്‍ട്ടിയില്‍ നിന്നു തന്നെ പുറത്താക്കി. മന്ത്രിയെ ഡെല്‍ഹി പോലീസ് മോദിയുടെ നിര്‍ദ്ദേശ പ്രകാരം അറസ്റ്റ് ചെയ്തു. കേസെടുത്തു.

മോദി 12 വര്‍ഷം ഭരിച്ച ഗുജറാത്തില്‍ 67% ജനങ്ങളും തൂറുന്നത് പൊതു സ്ഥലത്താണ്. അവിടെയാണ്, മോദി 2000 കോടി രൂപ ചെലവിട്ട് പറ്റേന്റെ പ്രതിമ സ്ഥാപിക്കുന്നത്. ആ പണം കൊണ്ട് എത്ര പേര്‍ക്ക് തൂറാന്‍ കക്കൂസുണ്ടാക്കി കൊടുക്കാമെന്ന് ഞാന്‍ താങ്കളെ പറഞ്ഞു പഠിപ്പിക്കേണ്ട ആവശ്യമില്ലല്ലോ. മുംബയില്‍ 1900 കോടി രൂപക്ക് ശിവജിയുടെ പ്രതിമ ഉണ്ടാക്കുന്നു. മംഗോളിയക്ക് 6000 കോടി രൂപ എറിഞ്ഞു കൊടുക്കുന്നു. നേപ്പാളിന്, ഒരു ബില്യണ്‍ ഡോളര്‍ കൊടുക്കുന്നു. അദാനിക്ക് ഓസ്ട്രേലിയയില്‍ ബിസിനസ് നടത്താന്‍ ഒരു ബില്യണ്‍ വേറെയും.

ലോകത്ത് ഏറ്റവും കൂടുത,ല്‍ ദരിദ്രര്‍ വസിക്കുന്ന ഒരു രാജ്യത്തെ ഭരണാധികാരി ചെയ്യേണ്ട കാര്യങ്ങള്‍ ഇതൊക്കെ ആണോ എന്ന് താങ്കള്‍  സ്വയം ചിന്തിക്കുക.

1) If Admiral Ramdas does not agree that his term has completed, then he has to produce his employment contract and prove it rather than blabbering in the media.

2) Double speak: You're not willing to accept the verdict of Delhi High court, and you're citing a mere remark by a judge as the ultimate truth? That's a mere observation of a judge, not the verdict. I disagree with the observation, and as I said, the law can't be against just Kejriwal. As long as there is a law against defamation, it should apply equally to both Kejriwal and media. Let the court analyze Kejriwal's plea, remove the unconstitutional provisions of the law against defamation and then apply the corrected law against both Kejriwal and the media.

3) Law minister: If his degree is fake then he should be punished. Unlike BJP, who's trying every trick in the book to save even a corrupt constable, nobody's shielding Tomar. While Tomar was arrested as if he is a dreaded terrorist, look at how Smriti Irani who's facing the same charges is being shielded by Modi. And Modi govt that's supposed to bring back all the black money and distribute @ Rs 15 lakhs per person has been implicated in aiding and abetting the black money kingpins like Lalit Modi.

As soon as the court ruled that ACB can arrest corrupt police officers, why did the LG immediately create a new top post in ACB and appoint his shingidi as the Joint Commissioner? Isn't it as clear as daylight that Modi's trying to rule Delhi through the backdoor?

@efby antony.......the treatment meted out to ramdass clearly shows the idea of lokpal that kejriwal has in mind.....

while i understand and respect your opinion on the defamation issue, all i pointed out was that it was not only me who felt that kejriwal has taken contradictory stand on it , even a supreme court division bench felt the same way

smriti irani's case is not at all comparable to tomar's case......tomar is said to have obtained admission to a law college based on a fake degree......in smriti's case she is said to have furnished different data relating to education at the time of different elections, a charge which has been levelled against sonia gandhi too.....in any case court has taken cognizance of the complaint and let her provide the explanation and if she is unable to do so she too would face the consequences......tomar was arrested and chargesheeted based on the investigation that found him guilty of using a fake degree certificate

as for blackmoney issue , the talk of 15 lakh per person is taking a figurative expression out of context.....that figure was indicated to show the huge quantum of black money that has been stashed away......in any case even if the black money were to be returned to the national economy , it is never going to be paid in to the account of individual citizens.....it was just like saying the national deficit indicates each person is in debt to the extent of such and such sum etc.....having said that i am not at all happy with the way Jaitley has handled the issue so far.....it is almost as if chidambaram continues to be the FM......in fact personally i think modi made a mistake in making smriti and jaitley ministers even after their defeat at the election......though it is a prerogative of the pm and there are precedents of congress doing the same, it was avoidable

as for lalith modi , i think chetan bhagat put it succinctly when he said this......there are two kinds of people in india; one...those who have had social/political/financial dealings with lalith modi and two....the remaining nobodies

as for centre attempting to rule through backdoor, i think i wrote several times about the current constitutional scheme of delhi administration .....the real power rests with the centre as per the constitution itself....there is no need for any backdoor

It is just a technicality. He is head of a state which is just 100 acres of land with buildings known as Vatican, in the city of Rome. It could be called as a spiritual principality rather than a country.

Vatican does not have a currency, does not have an army, no special judiciary, does not even have clear cut boundaries either.
